I have been avoiding posting here because it’s honestly pointless, but some of these arguments are so bad that I had to respond. First off, the argument of why she hasn’t responded. Because responding raises awareness of the photo. Right now if you don’t read French gossip mags then you have no idea this post exists. If she responds then it would be reported by any number of outlets.
And by neither confirming nor denying the photo is real she leaves other magazines and sites with a difficult legal hurdle. Right now the only newsworthy story you could run would say that she was caught topless. But any good paper would insist on independently verifying the story first. The best way to do that would be a comment from Emma herself. Meanwhile, if she denies it then the story is how a magazine posted a fake photo. Either way the legal hurdle is crossed. As it is right now, since this was a private resort it is highly unlikely any employee there would risk their job and reputation to verify the photo, making it all but impossible for another magazine to run it. Plus, if that is the only photo then they would basically be running an ad for a competitor. Go buy our competition to see Emma Watson topless is not a good story. None of that makes the photo fake. It means that it was likely a one off, maybe taken on a phone that was exclusively sold to one magazine, making any other shots or reports impossible, and by not commenting, Emma is keeping it that way.
